1. Agreement to these terms
These Terms of Use ("Terms") are an agreement between you and MoonBear ("MoonBear," "we," "us," or "our"). They apply to MoonBear mobile applications, websites, content, and related services that link to them (collectively, the "Services").
By using a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be legally able to enter this agreement. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you where required.
You are responsible for using the Services in compliance with laws that apply to you.
3. Limited license and acceptable use
Subject to these Terms, MoonBear grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended, lawful purpose.
You must not:
- copy, sell, sublicense, distribute, or commercially exploit a Service except where law permits;
- reverse engineer, bypass security, interfere with operation, or gain unauthorized access;
- use automation, scraping, or excessive requests that disrupt the Service;
- upload malicious code, impersonate another person, or use a Service for unlawful or harmful activity;
- remove ownership, copyright, trademark, or attribution notices;
- misuse purchases, promotions, advertising, or entitlement systems.
4. Informational and educational content
Some Services provide educational, study, reference, estimation, or productivity content. That content is offered for general informational purposes and may contain errors, omissions, or outdated material.
Your results in a Service do not guarantee any examination, certification, licensing, academic, financial, legal, health, or real-world outcome. You remain responsible for checking authoritative sources and exercising appropriate judgment.
5. No government or third-party affiliation
Unless a Service explicitly states otherwise, MoonBear is an independent publisher and is not sponsored, endorsed, administered by, or affiliated with any government agency, licensing authority, examination provider, school, brand, platform, or other third party mentioned in the Service.
Third-party names, marks, and content remain the property of their respective owners and are used only as permitted by law.
6. Purchases and paid features
A Service may offer one-time purchases, subscriptions, trials, or promotional offers. Before you confirm a purchase, the checkout screen will show the product, price, billing period, and material offer terms that apply.
- Prices and availability may vary by country, currency, platform, tax, and eligibility.
- Payment is charged by the applicable app store or payment provider, not directly by MoonBear unless clearly stated.
- Paid access is personal and may not be transferred, resold, or shared outside features the Service supports.
- Restoring purchases requires the same eligible store account and is subject to the store’s records and rules.
7. Subscriptions, renewals, and offers
If you purchase an auto-renewing subscription:
- the subscription renews automatically at the displayed billing interval unless canceled before renewal;
- your store account is charged according to the price and timing shown at checkout;
- uninstalling an app does not cancel a subscription;
- you can manage or cancel through the subscription settings of the store used for purchase;
- access generally continues until the end of the paid period after cancellation, subject to store rules.
Trials and promotional offers
A trial or introductory offer is available only when shown to you and may be limited by account, region, purchase history, or other eligibility rules. Unless canceled before the trial or offer ends, an eligible auto-renewing subscription converts to the price and billing period disclosed at checkout.
Always review the live checkout terms. They control the specific price, duration, renewal, and eligibility of your transaction.
8. Cancellation, refunds, and billing support
Manage or cancel a subscription through the store where you purchased it. Refund eligibility and processing are governed by the applicable store’s policies and mandatory consumer law.
- Canceling stops future renewals but does not automatically create a refund.
- If a purchase is missing, first use the Service’s restore option with the purchasing account.
- For unresolved entitlement issues, contact MoonBear with the service name and non-sensitive transaction details.
Do not email passwords, complete payment-card details, or other highly sensitive financial information.
9. Advertising and third-party services
Some Services may show advertisements or link to third-party content and services. Those third parties control their content, availability, purchases, and privacy practices. An advertisement or link does not mean MoonBear endorses the third party.
Your use of a third-party service is governed by that provider’s terms and policies. MoonBear is not responsible for third-party content or transactions to the extent permitted by law.
10. Intellectual property
The Services, including their design, software, artwork, text, branding, and original content, are owned by MoonBear or its licensors and protected by intellectual-property laws. These Terms do not transfer ownership to you.
If you send voluntary feedback, you allow us to use it without obligation to you, provided we do not publicly identify you without permission.
11. Changes, availability, and termination
We may update, improve, suspend, or discontinue all or part of a Service. Features, content, prices, and device support may change. We may restrict access when reasonably necessary for security, legal compliance, platform requirements, maintenance, or a serious breach of these Terms.
You may stop using a Service at any time. Sections that by their nature should survive termination—including ownership, disclaimers, and limitations—continue to apply.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” MoonBear disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
We do not promise that every Service will always be error-free, secure, current, or available on every device or in every location. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
13. Limitation of liability
To the fullest extent permitted by law, MoonBear and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunity, or goodwill arising from use of a Service.
Any total liability will be limited to the greater of the amount you paid MoonBear for the affected Service during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.
These limits do not apply where liability cannot lawfully be limited, including mandatory consumer protections.
14. Applicable law and disputes
Applicable law governs these Terms without removing any mandatory rights you have as a consumer in your place of residence. Before starting a formal claim, please contact us so we can try to resolve the issue informally.
15. Changes to these terms
We may update these Terms as our Services or legal obligations change. The “Last updated” date identifies the current version. If a change is material, we may provide additional notice where appropriate. Continuing to use a Service after updated Terms take effect means you accept them, where permitted by law.
